Article 1: Organizing Company
THE EXPLORERS NETWORK (hereinafter referred to as "THE EXPLORERS NETWORK"), a SAS with a capital of €1,000, registered with the RCS of PARIS under number 852 303 239, whose registered office is located at 141 avenue Felix Faure in Paris (75015), is organising from 20/07/2020 to 31/08/2020 23:59 (UTC+1) a contest (hereinafter referred to as "the Contest") entitled "Beauty of the South of France", the principle and procedures for participation of which are described in these rules.

Article 2: Contest theme
Each person who wishes to participate (hereinafter "The Participants") submits on the website "https://theexplorers.com" or on the "THE EXPLORERS" application (available on all app libraries) one or more contents, (hereinafter "The Participation") in the section of the said contest.

The objective of this contest is to contribute further to the Earth Inventory. In parallel with this objective, this competition encourages talented people to showcase their talents by illustrating the Earth Inventory and inviting them to try their hand at an expedition with The Explorers.

The content must be accompanied by a Title, a Category and be located in the region "Beauty of the South of France" in France.

Article 3: Participation conditions
3.1 To compete, participation is open from 20/07/2020 to 31/08/2020 23:59 (UTC+1) included; to vote in the Contest, participation is open from 20/07/2020 to 31/08/2020 23:59 (UTC+1) included.

3.2 Participation is strictly personal and the Participant may under no circumstances participate in the Contest in the name or on behalf of other persons. Collaborators of THE EXPLORERS NETWORK and all persons involved in the organization of this Contest cannot be named winners of the Contest.

3.3 The Participant guarantees that he/she is the author of the competing Photography, that he/she alone holds the copyright attached to the Photography and that it is an original and unpublished work. If the Photography has already been the subject of an award or exhibition, the candidate is required to notify the organizers of this Contest by email to contact@theexplorers.com

3.4 THE EXPLORERS NETWORK reserves the right to carry out all necessary verifications concerning the identity, postal and/or electronic address of participants.

3.5 Without THE EXPLORERS NETWORK or its partners being held liable, persons who have not provided their full contact details and identity or who have provided them in an inaccurate or misleading manner, as well as persons who refuse to collect, store and use their personal information strictly necessary for the purposes of organising the Contest will be excluded from the Contest and may not receive any prize.

3.6 In the event that the forms or the Photography submitted do not meet one of these criteria, THE EXPLORERS NETWORK reserves the right to exclude the Participant from participating in the Contest. Only duly completed applications will be accepted.

3.7 Participation in this Contest implies full and complete acceptance of these rules. Failure to comply with the abovementioned rules will automatically result in the automatic cancellation of participation and the possible granting of awards.

Article 4: Participation modalities
The competition period runs from 20/07/2020 to 31/08/2020 23:59 (UTC+1). The voting period for the competition runs from 20/07/2020 to 31/08/2020 23:59 (UTC+1).

To compete, the Participant must:
• Login or register on the "https://theexplorers.com" website or on the THE EXPLORERS application (available on application libraries) by clicking on "login" or "become an Explorer".
• To access the contest go to the "community" tab in the "contest" section, then click on "Beauty of the South of France" or on the website of https://provence-alpes-cotedazur.com/partagez-vos-plus-belles-images-de-la-region
• Read the " RULES " file; read and accept these Rules in their entirety by ticking the "I have read and accept the contest rules" button.
• Add their content via the "I participate" button from 20/07/2020 to 31/08/2020 23:59 (UTC+1).
• Give a title, and a description according to the choice, the history of Photography or Video, the artistic choices, what inspired Photography or Video and how it responds to the theme.
• Assign one of the following categories: Animals, Plants, Landscapes, Culture & Tradition, Other.

• The Participant may modify his contribution throughout the participation period from 20/07/2020 to 31/08/2020 23:59 (UTC+1). However, the participant must take into account the validation deadline, all content is subject to moderation.

To vote, the Voter shall:
• Login or register on the "https://theexplorers.com" website or on the THE EXPLORERS application (available on application libraries) by clicking on "login" or "become an Explorer".
• To access the contest go to the "community" tab in the "contest" section, then click on "Beauty of the South of France".
• Read the " RULES " file; read and accept these Rules in their entirety by ticking the "I have read and accept the contest rules" button.
• Go to the content for which the voter wishes to assign a vote from 20/07/2020 to 31/08/2020 23:59 (UTC+1).
• The voter can vote for as much content as he or she wants, but no more than one vote per content, every 24 hours.
• Each day, the Voter may withdraw his or her vote(s).
• Votes from a previous day cannot be changed.

Each day, the Voter may assign a vote per content to as many contents as he or she wishes.

Article 5: Photographic equipment & Technical details
The Photography must meet the following criteria:
• The digital file sent will be in.jpg,.png,.bmp,.gif format with a minimum size of 5 MB.
• The quality of a standard landscape orientation photo will be at least 5 megapixels, which represents a resolution of 2,500 x 2,000 pixels.

The Photography can be designed in portrait or landscape format, or in square format.

The Participants agree that the Title and Description (the history of photography) accompanying the Photography may be slightly modified for reproduction, editing and distribution without changing their nature (spelling corrections, slight rewriting for a better understanding...).

The media cannot be over-edited, i.e.: a photo that may contain a frame (borders), graphics (logo, clipart...), text (watermarks), a too deep change of the original colors (saturation, brightness...), too violent and repetitive transition effects or the appearance of a commercial brand.

Article 6: The Winner
The winner of the contest will be selected by the largest number of votes in the contest at the end of the voting period on 31/08/2020 23:59 (UTC+1). The announcement (hereinafter referred to as the "Announcement") will be made within 24 hours of the end of the voting period. Voting takes place only on the "https://theexplorers.com" website via the "community" tab and then the "contest" section, or on the THE EXPLORERS application (available on application libraries) via the "community" tab and then the "contest" section.

The 50 Entries with the most votes will be designated as the three winning Entries in the Contest, and their owners will be the Winners.

In the event that the winner is unable to benefit from his or her prizes, the second Entry with the most votes will be designated as the Contest Winner. In the event that the winner is unable to benefit from his or her prizes, the third Entry with the most votes will be designated as the Contest Winner. In the event that the winner is unable to benefit from his or her prizes, the fourth Entry with the most votes will be designated as the Contest Winner. In the event that the winner is unable to benefit from his or her prizes, the fifth Entry with the most votes will be selected as the Contest Winner.

Article 7: The Prizes
The first 3 participants with a the highest total of votes will receive the following reward :
- 1 year of subscription for “The Explorers +” and a The Explorers shirt for a total value of 100,88€.

The next 3 participants (with the 4th to the 6th highest totalsof votes) will receive :
- 1 year of subscription for “The Explorers +” and a The Explorers Tee shirt for a total value of 70,88€.

The next 4 participants (with the 7th to the 10th highest totalsof votes) will receive :
- 1 year of subscription for “The Explorers +” and a The Explorers cap for a total value of 65,88€.

The next 40 participants (with the 11th to the 50th highest totalsof votes) will receive :
- 1 year of subscription for “The Explorers +” for a total value of 35,88€.

Article 8: Copyright and image rights
The Participant undertakes that the photographs, videos, texts and/or any other content posted and/or distributed by him/her on the Website or via the Application shall not infringe the rights of third parties, and in particular intellectual property rights (brand, copyright, models in particular), the rights of individuals (in particular defamation, insults, insults, insults, denigration, harassment, etc.).), respect for private life (including the right to an image), public order and morality (in particular the promotion of crimes against humanity, incitement to racial hatred, violation of human dignity, violence against animals, violent or degrading images, etc.) and, more generally, the applicable regulations in force and the usual rules of politeness and courtesy.

THE EXPLORERS NETWORK shall ensure that content shared or provided by the Participant complies with these rules and reserves the right to immediately delete any content that it deems inappropriate, without prior notification from the Participant, and to take legal action, if necessary.

The Website and the Application use a system to protect the photographs and videos posted by the participant and making it impossible in principle for them to be recorded and duplicated by another user or third party, although THE EXPLORERS NETWORK cannot be held liable in the event of a failure of this system.

The Participant grants THE EXPLORERS NETWORK a license to use the intellectual property rights attached to the content (photos, videos, sounds, text) that it transmits for the purpose of sharing and distribution on the Website and/or from the Application. This license includes in particular the right of THE EXPLORERS NETWORK to reproduce, represent, use, if necessary in a modified form, such content on all or part of the Website and/or the Application and in any promotional or advertising documents relating to the Website and/or the Application, free of charge and in any form whatsoever, throughout the world.

The Participant must ensure that the clearly recognizable persons on the Photographs and Videos transmitted have given him/her permission to use their image for all the uses described above.

Article 9: Legal disputes and responsibilities
Participation in the Contest implies unreserved acceptance of the rules in their entirety.

If one or more provisions of these Rules are declared null and void or inapplicable, the other clauses shall retain their full force and scope.

Any inaccurate or misleading statement, fraud or contravention of any of the provisions of these rules will result in the Participant's disqualification. The decision to disqualify is made by THE EXPLORERS NETWORK.

No telephone or written requests will be answered regarding the interpretation or application of these rules, the mechanisms or terms and conditions of the Contest or the list of winners. In the event of a dispute, only a registered letter with acknowledgement of receipt will be admissible.

THE EXPLORERS NETWORK reserves the right, if circumstances require, to shorten, extend, modify or cancel this Contest and/or these Rules. Its responsibility cannot be engaged as a result. Participation implies knowledge and acceptance of the characteristics and limitations of the Internet, the lack of protection of certain data against possible hacking or hacking and risks of contamination by possible viruses circulating on the network.

THE EXPLORERS NETWORK cannot be held responsible in the event that one or more participants cannot connect to the https://theexplorers.com website or to the THE EXPLORERS application (available on all application libraries) due to any problem or technical defect related in particular to network congestion.

THE EXPLORERS NETWORK cannot be held responsible for any costs incurred by participating in the Competition.

THE EXPLORERS NETWORK reserves the right, at any time, and in particular for technical reasons of updating and maintenance, to interrupt access to the THE EXPLORERS NETWORK website and the competition it contains. THE EXPLORERS NETWORK cannot be held responsible for any theft or loss that may occur during the delivery of the prize.

Article 10: Assignment of authority
Any dispute that cannot be settled amicably shall be submitted to the competent courts designated in accordance with the French Code of Civil Procedure.

Article 11: IT and Libertie
The Personal Data communicated by the Participant to THE EXPLORERS NETWORK and/or disseminated by him/her from the Website or the Application and in the context of the use of the Services are subject to computer processing and are stored and used by THE EXPLORERS NETWORK, in its capacity as controller, throughout the duration of the Participant's registration on the Website and, where applicable, for an additional period defined below, for the following purposes:
• allow the Participant to access the Website and/or the Application and, where applicable, certain reserved areas, to use its various functionalities and to administer its account;
• put the participant in contact with other participants, if necessary according to the criteria defined by him/her;
• save and manage the participant's preferences;
• communicate with the Participant in order to respond to his requests and solicitations;
• manage the Contest proposed on the Website or the Application, and in particular the designation of the winner(s) and the awarding of the prize(s);
• send the Participant, at his request, information messages and/or promotional offers;
• measure the performance of the Website or Application, and the Services, and for example the number of pages viewed or the number of clicks, compile statistics and use them internally;
• respond to any disputes or requisitions by the authorities;
• comply with its legal obligations;
• meet certain legitimate interests, in particular those relating to the management of its activities;
and this in compliance with Act No. 78-17 of 6 January 1978 (known as the "Data Protection Act") as amended and the General Regulations for the Protection of Personal Data ("RGPD").
The processing operations carried out by THE EXPLORERS NETWORK in accordance with the purposes set out above are necessary to enable it to:
• fulfil its contractual obligations towards the Participant, in particular with regard to the delivery of the services expected from the Website or the Application;
• comply with its legal obligations;
• meet certain legitimate interests, in particular those relating to the management of its commercial activities.

Article 12: Property rights
In accordance with the laws governing literary and artistic property rights, the reproduction and representation of all or part of the elements composing this Competition are strictly prohibited. The brands mentioned are registered trademarks of their respective owners.

Article 13: Modifications
These rules are temporary and are intended as the first basis for the contest organisation. An additional jury may, for example, be added to the votes of the participants. The length of stay of the (elected) Academicians may also change.
In the event of a major change to the rules, during the contest period, all participants will be notified by email.
